Please read these terms and conditions carefully before using installHUB.

These terms set out the rules for using our platform (installHUB).  installHUB allows our customers to register and search for information and products/services relating to, and obtain quotations for installations of, electric vehicle charging points.  installHUB can be found at: http://www.installhub.com/portal.

Who we are and how to contact us

installHUB is operated by Platform D-Risk Limited ("We", “us” and “our”). We are registered in England and Wales under company number 09851561 and have our registered office at The William Currie Group Castle Chambers, 43 Castle Street, Liverpool, England, L2 9SH (Platform D-Risk)

By using installHUB you accept these terms

By using installHUB, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use installHUB.

We may make changes to these terms

We may amend these terms from time to time. Every time you wish to use installHUB, please check these terms to ensure you understand the terms that apply at that time. 

We may make changes to installHUB

We may update and change installHUB from time to time to reflect changes to our users' needs and / or to make improvements to it. 

Registered accounts

In order to use installHUB, you must have registered an account with installHUB.   We reserve the right to refuse the registration of any account, or remove any account registered on installHUB at our absolute discretion and for any reason whatsoever.

We may suspend or withdraw installHUB

installHUB is made available free of charge.

We do not guarantee that installHUB, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of installHUB for business and/or operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are responsible for ensuring that all persons who access installHUB through your account are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under these terms and conditions.

installHUB is directed at users in the UK

installHUB is directed primarily to users residing in the United Kingdom and is based on industry and practices governed by laws within that jurisdiction.  Whilst there may be some installHUB users from outside of the UK, we do not represent that content available on or through installHUB is appropriate for use or available in other locations.  

You must keep your account details safe

If you are issued with a user login, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user access to installHUB, at any time, if in our reasonable opinion you (or, for business customers, your organisation) have failed to comply with any of the provisions of these terms of use or any of the policies referred to under these terms of use.

If you know or suspect that anyone other than you knows your user login details or password, you must promptly notify us.

How you may use material on installHUB

We are the owner or the licensee of all intellectual property rights in installHUB, and in the material published on it. All such rights are reserved and you are not permitted to use any of our intellectual property rights, including any registered trademarks, except as permitted by these terms of use.

You may print off and may download extracts of any page(s) from installHUB for the purpose of reviewing and/or sharing quotations generated and information regarding products and services offered via installHUB to others and, for business users, within your organisation (Purpose) and you may draw the attention of others to content posted on installHUB. For that purpose, we grant you a non-exclusive, non-transferable, revocable licence to use any materials provided within installHUB for the Purpose at all times whilst you continue to have an account registered for, and access to, installHUB. Your licence to use any materials on or obtained from installHUB is conditional upon your continued compliance with these terms of use and will cease as soon as your access and/or account is de-registered or removed. 

You must not use any part of the content on installHUB for commercial or other purposes beyond the Purpose without obtaining our permission first.

If you print off, copy, download, share or repost any part of installHUB in breach of these terms of use, your right to use installHUB will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Do not rely on information on installHUB

The content on installHUB is provided for general information only about products and services (and their associated pricing) that are available for you to purchase from the EVC network of installers (EVC Network). It is not intended to amount to advice by us, on which you should rely, without first verifying the appropriateness of any individual products or services for your individual needs and requirements. 

When you obtain a quotation through installHUB for any product or services, that quotation will be open for acceptance by you for 14 days.  You should obtain professional or specialist advice (to include making enquiries regarding the suitability of products or services from the third party installer) before taking, or refraining from, any action to review, accept or reject any quotation on the basis of the content on installHUB.

Although we make reasonable efforts to update the information on installHUB, we make no representations, warranties or guarantees, whether express or implied, that the content on installHUB is accurate, complete or up to date.

We hereby exclude liability for any use made of, or reliance on, information provided through installHUB.

Third-party generated content is not approved by us

installHUB may include information and materials uploaded by third parties. This information and these materials have not been verified or approved by us. 

We hereby exclude liability for any use made of, or reliance on, other third-party content.

We are not responsible for websites we link to

Where installHUB contains links to any other third party sites or products and services provided by third parties or, when you accept a quotation we send you a link to a third party installer, those links or products / services are provided for your information only. Such links and products / services should not be interpreted as approval by us of those linked websites or of the products / services you may obtain from them.

We have no control over the contents of those websites or links.

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to installHUB or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  1.  use of, or inability to use, installHUB; or

  2. use of or reliance on any content displayed on installHUB.

In particular, we will not be liable for:

  1.  loss of profits, sales, business, or revenue;

  1. business interruption;

  2. loss of anticipated savings;

  3. loss of business opportunity, goodwill or reputation; or

  4. any indirect or consequential loss or damage.

If you are a consumer user:

Please note that we only provide installHUB for your domestic and private use. You agree not to use installHUB for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

How we may use your personal information

We will only use your personal information as set out in our http://www.installhub.com/privacy.

Uploading content to installHUB

Whenever you make use of a feature that allows you to upload content to installHUB, you must comply with the content standards set out in our Acceptable Use Policy at http://www.installhub.com/policy and we may remove any content or document in breach of this.

You warrant that any such contribution does comply with those standards and you are responsible for verifying the accuracy of any content before it is uploaded.  You will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

All content you upload to installHUB will be considered non-confidential and non-proprietary. 

You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store, download and copy that content and to distribute and make it available to third parties. The rights you license to us are described in Rights you are giving us to use material you upload below.

We also have the right (and you consent to our right) to disclose your identity to any third party who is claiming that any content posted or uploaded by you to installHUB constitutes a violation of their intellectual property rights, or of their right to privacy or that the content is inaccurate in any way.

You are solely responsible for securing and backing up your content. 

Rights you are giving us to use material you upload

When you upload content to installHUB, you grant us the following rights to use that content:

  1. a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, display and make available that user-generated content in connection with the products and services provided by installHUB and across different media.

We are not responsible for viruses and you must not introduce them

We do not guarantee that installHUB will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access installHUB. You should use your own virus protection software.

You must not seek to attack, gain unauthorised access, or misuse installHUB by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. In the event of such a breach, your right to use installHUB will cease immediately.

Rules about linking to installHUB

You may link to installHUB, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

We reserve the right to withdraw linking permission without notice.

Which country's laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and, if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
